Terms for installing or using NASP Rewards.

"Company", "we", "our", or "us" means Not A Side Project. "Services" means the NASP Rewards Shopify app, related APIs, customer-account experience, and this website. "You" means the merchant that installs or uses the Services through a Shopify store.

We may update these Terms and will date significant changes. Continued use after changes take effect means you accept them.

Account and Shopify

  1. NASP Rewards is installed and used through Shopify. You must have a valid Shopify store and comply with Shopify's terms and acceptable use rules.
  2. You are responsible for your Shopify account security and your store's activity through the Services.
  3. You are responsible for how loyalty features are presented to customers, including marketing claims, store policies, Store Credit and discount rewards.

The product

  1. NASP Rewards helps you award points from paid orders and configured customer activities, and lets customers redeem points for Store Credit or configured discount rewards. It also supports spending-based VIP tiers, tier benefits and gifts, referrals, and optional customer notifications, subject to the rules you configure and Shopify's available capabilities.
  2. Points balances, activity, and redemptions depend on accurate Shopify order, refund, customer, Store Credit, and discount data. Delays or gaps in Shopify APIs or webhooks can affect timing.
  3. You must review redemptions needing attention and follow the applicable Store Credit or discount guidance for uncertain outcomes.

Payment, trials, and plan changes

  1. Paid use is billed through Shopify App Pricing or another Shopify billing mechanism. Payment details and charge collection remain with Shopify.
  2. Current price, trial length, and included features appear in the Shopify App Store and Shopify's billing interface. Shopify's display is authoritative at installation.
  3. We may restrict app, customer-account and POS rewards access while your subscription is inactive.
  4. Email usage may incur additional charges beyond the included allowance. Accepted test emails also count toward usage. Current rates and included usage appear in Shopify's billing interface. Fees exclude taxes unless Shopify states otherwise. Shopify handles any applicable billing taxes.
  5. App charge refunds follow Shopify's processes and any refund policy we publish. Contact support@notasideproject.com for help.

Cancellation and termination

  1. Cancel by uninstalling NASP Rewards in Shopify Admin and completing any required subscription action. Email alone does not cancel the app.
  2. After uninstall, app access ends. We process data deletion and redaction under our Privacy Policy and Shopify compliance requirements.
  3. We may suspend or terminate access for abuse, security risk, non-payment, or material breach of these Terms.
  4. Threats or harassment of Company staff are grounds for immediate termination.

Changes to the Services and prices

  1. We may change features, fix defects or retire unsafe or unmaintainable behavior. Behavior is not guaranteed to remain unchanged.
  2. Pricing may change. When practical, existing subscribers will receive reasonable notice through Shopify or email.

Uptime, security, and privacy

  1. The Services are provided "as is" and "as available", without a formal service-level agreement.
  2. You agree that we may process data as described in ourPrivacy Policy.
  3. We use third-party infrastructure to operate the Services. Shopify is a required dependency for installation, authentication, orders, customers, Store Credit, discounts, and billing.

Acceptable use

  1. Do not use the Services for unlawful activity, fraud, spam, or to undermine Shopify, payment networks, or other merchants.
  2. Do not probe, disrupt, or reverse engineer the Services except where applicable law allows.
  3. Do not process data through the Services unless you have the right to.

Intellectual property

  1. We own the Services, including software, branding, and site design. You receive a limited right to use the app while installed and in good standing.
  2. You retain rights to your store content and customer relationships. You grant us a limited license to process that data to provide the Services.

Liability

To the maximum extent permitted by law, the Company is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business interruption arising from the Services.

Our total liability related to the Services will not exceed the amount you paid through Shopify during the three months before the claim, or USD 100 if you paid nothing, to the extent such a limit is enforceable.

Some jurisdictions do not allow certain limitations. In those places, our liability is limited to the fullest extent permitted.

Governing law

These Terms are governed by laws applicable to the Company's principal place of business, without regard to conflict-of-law rules, except where mandatory law requires otherwise.
